NEW ORLEANS — The Louisiana Supreme Court has ordered a state appeal court to reconsider its ruling that nurse-practitioners cannot be covered by the state's $500,000 cap on general malpractice awards. The ruling stems from a case in which a child's cancer went undiagnosed through 32 appointments with a nurse practitioner before her first birthday. The 3rd Circuit Court of Appeal in Lake Charles ruled the Legislature unconstitutionally covered nurse-practitioners by the cap.
