The parents of a 1-year-old toddler are taking to social media in search of justice after their son was allegedly assaulted by his babysitter.

Joshua Marbury took to Facebook claiming that his 1-year-old son was smacked across the right side of his face by his babysitter. Joshua says that multiple doctors confirmed it and along with detectives claimed the blow could have killed him.

Marbury was on a date with his wife while Jacob was left in the care of a family friend. Upon their return, they found the babysitter asleep on the couch as Jacob cried. The next morning Jacob's mother, Alicia Quinney, immediately noticed something wasn't right.

The first thing I saw was a black eye.

Joshua and Alicia took their son to the hospital and filed a police report, but Marbury claims the babysitter is protected by a 2012 Oregon Court of Appeals ruling that states a victim must verbally attest to their abuse in order for their abuser to be prosecuted.

Marbury claims he even got a verbal confession from the abuser claiming they did hit the child, but still nothing can be done.

STILL this person was not arrested because they had to build a case and a jury to find him guilty BEFORE they go to jail. Side note if im not mistaken (if i strike a person in the face and the cops were called i would be put in hand cuffs immediately). After TWO months of waiting we only find out that charges are dropped BECAUSE my one year old cannot tell you verbally he was abused and my son did not show he was in pain OR that this person "intentionally" did this.

Photos showing the boy's apparent injuries have been shared hundreds of thousands of times and a petition has gotten over 14,000 signatures in an effort to have the Oregon Supreme Court overturn the lower court's ruling.
