AMITE CITY, La. (AP) — A Louisiana man who officials say caused a crash that fatally injured his 5-year-old son has been sentenced to 18 years in prison.

The Advocate reports 55-year-old Toney Gallo pleaded guilty Monday to negligent homicide. Court documents state the boy suffered head trauma in the March 2018 crash in which Gallo ran off the road and hit a concrete barrier in Tangipahoa Parish.

Investigators determined Gallo had been driving with a blood alcohol level of 0.231, which is nearly three times the legal limit. It was his third DWI offense.

The 5-year-old was hospitalized after the crash. Court documents say he died in May 2018.

Gallo had been scheduled to go to trial Monday. He was sentenced immediately after entering the guilty plea and will receive credit for time served.
