Trooper Warns – Illegal To Smoke In Car With Children
Today on 'Mornings With Ken and Bernie' Troop I public information officer Stephen Hammons explained that it is illegal to smoke in a vehicle with a child in a car seat.
In addition to safety tips concerning driving in rainy weather Trooper Hammons informed listeners that it is illegal to smoke cigarettes while a child of any age is restrained in a child safety seat. Hammons said,
"Many times we will stop an individual for another traffic violation and they are surprised when they are written up for smoking while driving with a child in a safety seat. Some drivers argue that they had their windows down but that is still a traffic violation. Just as with other violations ignorance of the law does not constitute innocence."
Even with all four windows down in a vehicle Hammons said the law feels the child is being endangered therefore a crime is being committed.
