UPDATE May 30, 2012: Trooper Stephen Hammons says Jarvin Malveaux has been released from the hospital and taken into Louisiana State Police custody.

Malveaux faces charges of resisting a police officer with force or violence, attempted disarming of a peace officer and attempted 1st degree murder of a peace officer. He was booked into the Lafayette Parish Correctional Center. The case remains under investigation.

4:10 p.m. May 22, 2012: The shoplifting suspect who was shot Monday night during a struggle with a Lafayette Police officer has been identified.

Trooper Stephen Hammons says 30-year-old Jarvin Malveaux of Lafayette remains in critical condition. Hammons says the officer was trying to apprehend Malveaux on North Buchanan Street after police were called to Wal-Mart on the Evangeline Thruway regarding a shoplifting suspect. Police say Malveaux fit the the description of the suspect.

Reportedly, the two wound up fighting over the officer's gun. That's when several shots were fired, critically injuring Malveaux. The officer suffered minor injuries. State Police are investigating the incident.
