The Third Circuit Court of Appeals is upholding the 13-month prison sentence handed down to Seth Fontenot for the death of 15-year-old Austin Rivault, according to our news partners at KATC.

This means Fontenot is still on track to be released from LaSalle Correctional Center in Olla on May 15. Prosecutors appealed the sentence because they felt it was too lenient and illegal.

Fontenot was found guilty of manslaughter in the 2013 shooting death of Rivault. His attorney says Fontenot never denied shooting the teen, but claims he was aiming at his truck which he thought was being broken into. Two other teens were injured in the shooting.
