Louisiana Crawfish Company Sued

Louisiana Crawfish Company opened for business in 1985 in Natchitoches, Louisiana, and quickly expanded with the opening of two more Louisiana locations in New Orleans and Bunkie.

Louisiana Crawfish Company is a family-owned business that specializes in shipping live crawfish and other seafood products nationwide.

The company reportedly ships over 2 million pounds of Louisiana crawfish, tail meat, and Louisiana seafood nationwide each year across America.

As a matter of fact, Louisiana Seafood Company has grown into the largest live crawfish shipper in the U.S.

Did you know this was even something people could sue over?

It certainly is, and it's called the TCPA, or Telephone Consumer Protection Act.

The TCPA (Telephone Consumer Protection Act) is a U.S. law enacted in 1991 to protect consumers from unwanted telemarketing calls, robocalls, and spam texts.

It restricts businesses from making unsolicited calls and using auto-dialing systems or prerecorded messages without prior express consent from the recipient.

The recent lawsuit filed against Louisiana Crawfish Company claims that they sent at least 10 unsolicited texts before 8 AM.

"The lawsuit, filed in the Central District of California by plaintiff Mason Ibarra ('Plaintiff'), accuses Louisiana Crawfish Company of violating the TCPA by sending at least 10 unsolicited marketing texts before 8 AM.

According to the complaint, texts were sent as early as 6:40 AM, 7:01 AM, and 7:30 AM—times the TCPA clearly prohibits for telemarketing communications."

If you ask us, it doesn't seem as if Louisiana Crawfish Company was trying to do anything nefarious here, it simply seems like a matter of not thinking about time zones.

Under the TCPA, businesses can’t make telemarketing calls or texts before 8 AM or after 9 PM (local time for the recipient).

How much could Louisiana Crawfish Company be fined if found guilty of violating TCPA laws?

According to natlawreview.com, the plaintiff is seeking damages of $500 per text, or $1,500 per text if the violations are deemed willful, as well as an injunction to stop Louisiana Crawfish Company from sending any further messages.
